JUDGMENT : 1. Heard learned counsel for the parties. 2. The petitioner has been made accused in connection with Chandwa P.S. Case No. 93 of 2019, corresponding to G.R. Case No.112 of 2022 registered under sections 147/148/149/341/323/385/386/436/427 of Indian Penal Code and Section 27 of the Arms Act and Section 17(i)(ii) of the CLA Act. 3. The prosecution case in brief is that the informant is working as Tori Coal siding In-charge for R. K. Transport Pvt. Ltd. It is stated that on 11.07.2019 at about 09:45 P.M. about 20-25 armed miscreants of JJMP group and 10-15 other members reached the Chandwa (Tori) siding and started firing indiscriminately at the security guards and drivers. Three Poclain, seven Hyvas and two trucks were torched by them and when the police reached there, they were also attacked by the miscreants. It was alleged that the JJMP member including the petitioner have committed this occurrence and they were shouting to burn the vehicles because they did not receive money from the siding. 4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence at all rather he has been falsely implicated in this case. 7. Considering the gravity of the offence and the criminal background of the petitioner, I am not inclined to release the above named petitioner, on bail. Accordingly, the prayer for bail of the petitioner is rejected. 8. However, the learned trial court is directed to expedite the trial and conclude the same within the time requested by the concerned trial court, failing which, the petitioner is at liberty to renew his prayer for bail.
