JUDGMENT : 1. Heard learned counsel for the parties. 2. The petitioner has been made accused in connection with I.E.L. P. S. Case No. 08 of 2022 (G. R. No. 374 of 2022) registered under sections 302/34 of Indian Penal Code. 3. As per FIR the allegation against the petitioner is that on 29.03.2022 at about 5:00 pm Raju Karmali, husband of the informant Basanti Devi, was returning to his house from his workplace. On the way, the petitioner who is the agent of Sahara India, was requested by her husband that his deposit has become matured and so his matured amount may be withdrawn. It infuriated the petitioner and both of them entered into verbal altercati on. It is alleged that the petitioner has assaulted to husband of the informant on various parts of the body, which was narrated to his wife. The informant saw marks of injuries over different parts of body of her husband. He has also received internal injuries due to which he died on next day morning. 4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence at all rather he has been falsely implicated in this case. Petitioner undertakes to co-operate with the trial of the case and remain physically present on each and every date till the conclusion of the trial and shall not indulge in tampering with the prosecution evidence or influence the witnesses or gain over them. It is next submitted that the petitioner has no criminal antecedent. The petitioner is languishing in judicial custody since 14.03.2023 without any rhymes and reasons. Hence the petitioner may be enlarged on bail. 5. Learned Addl. P.P. has opposed the prayer for bail of the petitioner. Hence, the petitioner may not be enlarged on bail. 6. From the postmortem report of the deceased, it appears that bruises over the right side of forehead, right elbow, posterior aspect of right arm, lateral aspect of right shoulder, upper and mid zone of back, multiple in numbers, could not be counted, were ante-mortem in nature and likely to be produced by hard and blunt object. 7. Considering the facts and circumstances of this case, the nature of allegation against petitioner coupled with materials available on record showing direct involvement of petitioner in offence of murder, I am not inclined to release the above named petitioner, on bail.

Accordingly, the prayer for bail of the petitioner is rejected.
