This petition under Article 226 of the Constitution of India has been filed seeking the following reliefs :- (i) Issue a writ in the nature of mandamus by directing the respondents to issue relieving order of the petitioner forthwith pursuant to his application dated 6.9.2023 (P9) seeking retirement (ii) Any other relief which this Hon’ble Court and the petitioners entitled be also granted. 2. It is submitted by counsel for petitioner that petitioner is working on the post of Deputy Superintendent of Police. He is intending to contest the forthcoming State Assembly Election from a constituency of Chhattisgarh. An application for voluntary retirement was submitted on 6.9.2023 and since it is an unilateral act, therefore, respondents are only required to issue relieving order. However, the same is not being done. 3. A Coordinate Bench of this Court by order dated 25.10.2023 had directed the State Counsel to seek instructions. On 26.10.2023 the Coordinate Bench has recused, therefore, this case has come before this Court. 4.

From plain reading of this communication, it is clear that in the evening of 26th October, 2023 i.e. Yesterday, the case of the petitioner for acceptance of his voluntary retirement has been placed before the Competent Authority for administrative approval. Although it is the contention of counsel for petitioner that since an application for voluntary retirement is an unilateral act which does not require any approval but even then relieving order is required. 6. It is also the case of petitioner that last date for submission of nomination paper is 30th October, 2023 and in case, if relieving order is not issued, he would be deprived from contesting the election. 7. Be that whatever it may be. 8. The case of the petitioner has already been placed before the Competent Authority for administrative approval in the evening of 26th October, 2023. In view of the urgency expressed by counsel for petitioner, it is directed that the Competent Authority shall take a final decision latest by tomorrow i.e. 28.10.2023 and communicate the same to the petitioner. While considering the case of petitioner, the Competent Authority shall keep in mind the law laid down by Division Bench of this Court in the case of Narayan Prasad Ram Ratan Kachhwaha v. District & Sessions Judge, Ratlam & Ors. reported in 1997 (2) MPLJ 665 ; State of M.P. v. Dr. Harendra Jaseja, reported in 2014 SCC Online MP 5940; Dr. Durgesh Rathi v. State of M.P. & Anr. reported in 2022 (2) MPLJ 380 and an order passed by Coordinate Bench of this Court in the case of Ruksana Begum Siddiqui v. State of M.P. & Ors. reported in 2009 SCC Online MP 816 and an order passed by Indore Bench of this Court in the case of Dr. Bharat Singh Chouhan v. Public Health & Family Welfare Department & Ors. in W.P.No.6549/2015 decided on 22.9.2015. 9. With aforesaid observation, the petition is finally disposed of.
