ORDER : 1. The petitioners are wife and children of the deceased – Anil Kumar, who unfortunately met with a road accident on 17.10.2015 and was crushed under the crane, resulting into his instant death at the spot. The accident took place within the jurisdictional area of Panaji, Goa where FIR No.317 of 2015 was registered under Section 279, 304A of the Indian Penal Code, 1860. Thereafter, the petitioners filed the Claim Petition seeking statutory compensation under Section 166 of the Motor Vehicles Act, 1988. We are informed that the said claim is being contested by respondent No.4 also. It further appears that at the time of accident, the petitioners were residing at Panaji along with the deceased – Anil Kumar. Since they were left with no other source of livelihood, the petitioners shifted to Aurangabad District, Bihar. It is in this backdrop that a prayer for transfer of Claim No.50/2017, titled as “Smt. Bhagirathi Devi and Ors. vs. Shri Rafiq Khan and Ors.”, filed under Section 166 of the Motor Vehicles Act, 1988, which is pending before the Motor Accidents Claims Tribunal at Panaji to the Motor Accidents Claims Tribunal, Aurangabad, Bihar, has been made. 2. We have heard learned counsel for the petitioners as well as learned counsel for respondent No.2 – owner of the vehicle and carefully perused the material placed on record. 3. Keeping in view the extreme hardships being faced by the petitioners, who have lost their sole bread earner, we are satisfied that it is a fit case to transfer the proceedings from Panaji, Goa to Bihar. 4. Consequently, the Transfer Petition is allowed and the Claim No.50/2017, titled as “Smt. Bhagirathi Devi and Ors. vs. Shri Rafiq Khan and Ors.”, filed under Section 166 of the Motor Vehicles Act, 1988, which is pending before the Motor Accident Claims Tribunal at Panaji is ordered to be transferred to the Motor Accident Claims Tribunal, Aurangabad, Bihar. The records be forwarded to the Transferee Court forthwith. 5. The witnesses who are residents of Panaji, Goa may be examined by the Tribunal through virtual mode. 6. As a result, pending interlocutory applications also stand disposed of.
