JUDGMENT Ravindra Maithani, J. - Applicant- Kirshnanand Murari is in judicial custody in Case Crime No. 153 of 2020, under Sections 8 and 20 of the Narcotic Drugs and Psychotropic Substances Act, 1985, ('the Act'), Police Station Champawat (Chowki Chalthi), District Champawat. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. According to the FIR, on 07.12.2020, 01 kg.300 gm. Charas was allegedly recovered from the applicant. 4. Learned counsel for the applicant would submit that the FIR is must delayed in this case, because, according to the FIR, the applicant was finally arrested at 4:00 p.m., after recovery of the alleged article. But, the FIR was lodged on 08.12.2020 at a Police station, which according to the FIR is at 13 Km. distance from the place of occurrence. 5. Learned State Counsel would submit that in fact, the place of incident falls within Police Chowki Chalthi, where there was no facility of CCTNS (Crime and Criminal Tracking Network System) connectivity, therefore, at Police Chowki Chalthi, the case was registered on 07.12.2020. 6. At the time of hearing, the G.D. extract of Police Chowki Chalthi has been placed for perusal of the Court. According to which, by G.D. Report No. 40 at 5:31, the details of the case was entered into G.D. 7. The submission which is made by learned State Counsel makes it clear that, in fact, there is no delay in lodging the FIR. The delay is in entering the FIR in CCTNS. The trial is underway. There is no other ground raised on behalf of the applicant. 8. Having considered, this Court is of the view that it is not a case fit for bail. Accordingly, the bail application deserves to be rejected. 9. The bail application is rejected.
