JUDGMENT : Kaushal Jayendra Thaker, Ajit Singh, JJ. Order on Criminal Misc. Suspension the Sentence Application No.1 of 2018. 2. Heard Sri C.L.Chaudhary, learned counsel for the appellant, learned A.G.A. for the State. 3. The instant bail application has been filed by applicant-appellant Danish pending appeal against the judgment and order dated 20.06.2018 passed by Additional Sessions Judge, Court No.7, Ghaziabad in Sessions Trial No.845 of 2013 (State vs. Danish and another) whereby the learned Additional Sessions Judge has convicted the accused-appellant under section 302 of IPC and sentenced him to undergo for a R.I. of life imprisonment with a fine of Rs.10,000/- and in case of default in payment of fine, further to undergo one years additional imprisonment. Further, convicting and sentencing the appellant under section 201 IPC to undergo for imprisonment of seven years and a fine of Rs.2,000/- and in default in payment of fine, to undergo for a further imprisonment of two months. 4. The submission of learned counsel for the applicant is that the appellant has been falsely implicated in the present case. He further submits that there is no eye witness of the said incident and there is no recovery of any incriminating article from the appellant. 5. As against this, learned A.G.A. for the State has taken us through the judgment and has vehemently opposed to the grant of bail. 6. Without delving into the merits and demerits of the matter, we feel that this is not a fit case where we exercise our jurisdiction to grant bail, for the reasons, that evidence on record shows that the deceased has been done to death mercilessly due to strangulation in the house of the husband/appellant. 7. In that view of the matter, this bail application is rejected. Order on Appeal. 8. Office to prepare the paper book within four weeks from today and list the matter on 03.03.2023 for final hearing.
