ORDER Our attention is drawn to paragraph 9 of the preliminary counter affidavit filed by the respondent - Union of India, which reads as under: - “9. It is highlighted that the answering Respondent have no per se objection against the two Petitioners before this Hon’ble Court. The two Petitioners were found meritorious for grant of PC by the answering Respondent, and would have been reinstated and granted PC if the judgment of this Hon’ble Court, detailed below, had not intervened.” 2. In view of the aforesaid statement, we dispose of the present writ petition with the direction that the two petitioners, namely, Lt. Commander Manish Kumar Singh and Lt. Commander Tarun, shall be reinstated and will be granted permanent commission. This order/direction would be, however, subject to the proceedings pending before the Armed Forces Tribunal (AFT). 3. We clarify that the directions given above will not, in any way, affect the outcome of the proceedings before the AFT. 4. Necessary orders, in terms of the aforesaid counter affidavit and directions given hereinabove, will be issued within a period of two weeks from today. 4. Recording the aforesaid, the writ petition is disposed of.
