NANI TAGIA

body2024
Nani Tagia, J.—Heard learned counsel for the parties. 2. This writ petition is directed against the result dated 21.02.2024, published by Bihar Technical Service Commission pursuant to advertisement nos. 04/2020 to 09/2020, whereby as many as 1328 candidates have been selected for appointment as Aayush Medical Officer. 3. The ground of challenge to the impugned result dated 21.02.2024 by the petitioner is that the same has been prepared by the respondent authorities in violation of the Bihar Reservation in Vacancies of Posts and Services and in Admissions in the Educational Institutions (for Economically Weaker Sections) Act, 2019 as well as notification relating to reservation issued by the Central Government. 4. Accordingly, the learned counsel for the petitioner contends that the impugned result dated 21.02.2024, published by the Bihar Techincal Service Commission is liable to be set aside and quashed. 5. Though, the petitioner has challenged the impugned select list dated 21.02.2024, published by the Bihar Technical Service Commission on the ground mentioned hereinabove, but the selected candidates for appointment on the post of Ayush Medical Officer, 1328 in number, have not been made party respondents in the present writ petition. 6. Under the circumstances, since no interference can be made to the impugned select list without hearing the candidates selected by the impugned select list dated 21.02.2024, this Court has no option but to dismiss the instant writ petition. 7. Accordingly, the instant writ petition is dismissed.
