ORDER : 1. Heard Mr. M. Smith, learned counsel for the appellant and M. K.P. Pathak, learned Amicus Curiae for the respondent Nos. 1 & 2. 2. During the deliberation of the matter, it is seen that the appellant inadvertently preferred this criminal appeal against the judgment and order dated 16.02.2010 passed by the learned Special Judicial Magistrate, Assam, Guwahati in Case No. CR 1861/2006, whereby the respondents/accused were discharged under Section 245 (1) CrPC where the proceeding against them was initiated by the Employees State Insurance Company, instead of preferring a criminal revision petition. 3. Mr. Smith, learned counsel for the appellant prays for some time to approach the appropriate forum for filing necessary application. 4. Prayer is allowed. 5. With the above observation, this criminal appeal stands disposed of.
