ORDER : 1. Having heard the learned counsel for the parties and looking at the nature of the dispute inter-se the parties, we confirm the interim order passed by this Court on 19.05.2023 to the effect that the respondents shall not encumber, alienate, part with possession, create any third party rights or enter into any agreement to sell or sell (except existing mortgages with the banks, if any) to the extent of units with a minimum covered area of 30,000 sq. ft. 2. The area, which will be governed by the aforesaid order, will be demarcated on an architectural plan and would be submitted before the National Company Law Tribunal, Ahmedabad Division Bench, Court-1, Ahmedabad, Gujarat. 3. An affidavit in support of the demarcation of the area, in terms of the order passed by this Court today, will be also filed along with the architectural plan. 4. It is, however, clarified that the interim order and directions should not be read as an expression of opinion on the merits of the case. 5. Recording the aforesaid, the appeal is disposed of. 6. Pending applications, if any, shall stand disposed of.
