JUDGMENT : SANJAY KUMAR DWIVEDI, J. 1. Heard Mr. A.K. Sahani, learned counsel for the petitioner and Mr. Sanat Kumar Jha, learned counsel for the State. Nobody appears on behalf of opposite party no. 2 on repeated calls. 2. This petition has been filed for quashing of the entire criminal proceeding in connection with TELCO (Birsa Nagar) P.S. Case No. 312 of 2012, corresponding to G.R. No. 2878 of 2012, pending in the Court of the learned Additional Chief Judicial Magistrate, Jamshedpur. Subsequently, the order taking cognizance dated 02.06.2014 was challenged by way of filing I.A. No. 5797 of 2016, which was allowed vide order dated 07.09.2016. Thus, the order taking cognizance dated 02.06.2014 is also under challenge in this petition. 3. Mr. Sahani, learned counsel for the petitioner confines his prayer with regard to the FIR registered under Section 3(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. He further submits that charge has already been framed and trial is going on. 4. In the FIR, there is allegation that the petitioner was pressing hard to establish physical relationship with opposite party no. 2. Further, charge has already been framed and the learned Court has been pleased to take cognizance against the petitioner. What are the materials in the charge-sheet, that is not before the Court. Further, the trial is going on. 5. In view of the above facts, no case of interference is made out. Accordingly, this petition is dismissed. 6. However, this order will not prejudice the case of the petitioner and trial shall proceed, in accordance with law. 7. Pending I.A. if any, is disposed of. 8. Interim order, if any granted by this Court, is vacated.
