ORDER : Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a direction in the nature of Writ of Declaration, declaring that the Section 47(4) of the Indian Stamp Act, 1899 is illegal, ultra-virus, unconstitutional void and unenforceable. 1. This writ petition is filed seeking a Declaration to declare that the Section 47(4) of the Indian Stamp Act, 1899 is illegal, ultra-virus, unconstitutional void and unenforceable. 2. There is no representation on behalf of the petitioner. 3. The learned Additional Government Pleader appearing for the third respondent and learned counsel for the respondents 2, 4 and 5 are present. 4. Today, this matter is listed under the caption “for dismissal” there is no representation for the petitioner. Even on an earlier occasion, there was no representation on behalf of the petitioner. It appears that the petitioner is not interested in prosecuting this case any more and hence, this writ petition is dismissed for non prosecution. Costs made easy.
