JUDGMENT : 1. Sri T.C. Krishnan, learned counsel for the appellants is present. Learned counsel submits that in this First Appeal, the defendants questioned the preliminary decree passed in the suit for partition. Now it was amicably settled out of the Court among the parties and therefore, seeks permission to withdraw the appeal. 2. There is on record, a letter addressed to the Registry dated 29.01.2024 in this regard, notice of this was served on the other side. 3. Considering these facts, permission is accorded. 4. In the result, this appeal is ‘dismissed as withdrawn’. No order as to costs. As a sequel, miscellaneous petitions, if any pending, shall stand closed.
