ORDER : Farjand Ali, J. 1. The petitioner, who has been named as an accused in number of FIRs’, the details of which are mentioned in the Schedules attached with this order (which shall be treated as part and parcel of this order) has preferred the instant criminal writ petition under article 226 of the Constitution of India seeking release in all the matters collectively for a limited period of 30 days for enabling him to take care of his ailing father, who is suffering from serious heart disease. 2. It is averred in the writ petition that father of the petitioner is 69 years old and is suffering from heart disease and due to severe chest pain he has been admitted to ICCU at SMS Medical College and SMS Hospital, Jaipur on 15.10.2024 and he has been advised to undergo surgery. It is further submitted that the wife of the petitioner is also suffering from Arthritis disease and is under treatment. There is no other responsible member in the family to take care of his father. In these circumstances, the presence of the petitioner is essential for taking care of his father. Thus, it is prayed that the petitioner may be released on temporary bail in all the matters collectively. 3. Learned Public Prosecutor has opposed the prayer made by the petitioner. 4. Considering the overall facts and circumstances of the case and upon going through the medical record of the father of the petitioner annexed with the writ petition and taking a humanitarian view of the matter, the instant writ petition is allowed and it is ordered that the petitioner shall be released on temporary bail in all the matters mentioned in the annexed Schedules collectively and any other case, which remains to be mentioned in the Schedules, for a period of 30 days from the date of his actual physical release upon furnishing a personal bond in the sum of Rs.5,00,000/- and two sound and solvent sureties of Rs.5,00,000/- each (one of which shall be of any of the family member of the petitioner) to the satisfaction of the Superintendent (or other competent jail authority) of the District Jail, Sikar. The concerned Jail authority shall be at liberty to impose any other usual terms and conditions for surrender of the petitioner.
