ORDER : Subba Reddy Satti, J. 1. The above writ petition is filed to declare the action of respondents in depriving the petitioner for promotion to the post of District Registrar (Regular) for the panel years 2019 onwards, despite the similarly placed person was benefited by Memo No.20340/VIG.I(2)/2011-1, dated 24.10.2011 and non-consideration of the petitioner’s representation dated 29.04.2024, as contrary to G.O.Ms.No.679, dated 01.11.2008, G.O.Ms.No.91 dated 12.09.2022 and Circular Memo. No.15813/Ser.C/2007 General Administration (Ser.C) Department, dated 11.09.2007, G.O.Ms.No.257, dated 10.06.1999 and G.O.Rt.No.408 Revenue (Vigilance-IV), dated 27.04.2023, as illegal and arbitrary. 2. Heard Sri G.V.S. Kishore Kumar, learned counsel for the petitioner and Sri S.Raju, learned Assistant Government Pleader for Services appeared for the respondents. 3. Learned counsel for the petitioner would submit that the ACB authorities conducted a surprise check in the Sub-Registrar Office, Sullurupet, SPSR Nellore District, while the petitioner was working as Sub-Registrar. A disciplinary proceedings vide TEC No.1 of 2017 were initiated. The petitioner submitted a written defence. After abolition of Tribunal, disciplinary proceedings were transferred to the Commissioner of Inquiries. The Commissioner of Inquiries submitted the inquiry report dated 29.09.2023. Thereafter, respondent No.1 issued Memo No.REV01-REGS0CIRV(ACBC)/2/2022-VIG-II, dated 01.04.2024 (Ex.P6) directing the petitioner to submit an explanation. The petitioner submitted explanation dated 29.04.2024 (Ex.P5). However, respondent No.1 has not passed any order so far. 4. Though the learned counsel for the petitioner has drawn the attention of this Court to the alleged irregularities in conducting inquiry, at this juncture, this Court cannot go into those aspects. 5. Learned counsel for the petitioner also would submit that the petitioner was promoted on Adhoc basis from Sub-Registrar to the District Registrar vide G.O.Rt.No.629 Revenue (Registration.I) Department, dated 05.10.2021 (Ex.P1). Thereafter, by proceedings No.E/652/2022, dated 21.05.2022 (Ex.P4), salary was fixed under FR 22 (a)(i). He also would submit that though the petitioner is entitled for further promotion i.e. to the post of District Registrar (Regular) for the panel year 2023-24, the same was not considered due to pendency of aforementioned charge memo. 6. Learned Assistant Government Pleader for Services submitted instructions of the Special Chief Secretary to the Government. The relevant portion of the instructions reads as follows: “It is further to inform that the C&IG(R&S) who is competent authority to finalise seniority in the cadre of Sub-Registrar, Grade-I, which is feeder category for promotion as District Registrar has not yet furnished final seniority list.

With regard to conducting DPC for promotion to the post of District Registrar, it is submitted that no proposal have been received from the C&IG(R&S) so far.” 7. Learned Assistant Government Pleader for Services seeks time to file counter affidavit. 8. List the matter on 30.12.2024. 9. In the meantime, respondent No.1 shall consider the reply submitted by the petitioner dated 29.04.2024 (Ex.P5) to the Memo No.REV01-REGS0CIRV(ACBC)/2/2022-VIG-II, dated 01.04.2024 (Ex.P6) and pass appropriate orders in accordance with law.
