JUDGMENT : The present Civil Miscellaneous Appeal is filed against the order dated 22.07.2011 in W.C.No.1 of 2009 on the file of the Commissioner for Workmen’s Compensation Act & Assistant Commissioner of Labour, Gudur, whereunder the opposite party Nos.1 & 2 made jointly and solely responsible for the compensation. 2. The Insurance Company preferred this appeal and on 21.07.2016, this Court passed the following order:- “Learned counsel for the petitioner(s)/appellant(s) is permitted to take out personal notice to respondent No.3 through registered post with acknowledgment due and also to take steps due as against respondent No.5 within four weeks. Failing which, petition/appeal shall stand dismissed without reference to the Court as against respondent Nos.3 and 5.” 3. As per the endorsements made by the Registry, the order is not complied and as a consequence of the order passed on 21.07.2016, the appeal against respondent No.3/Opposite Party No.1 before the Commissioner i.e., the employer stood dismissed. As the appeal is dismissed against the owner and the award of Commissioner has attained finality, no orders can be passed in this Civil Miscellaneous Appeal. 4. Hence, this Civil Miscellaneous Appeal is dismissed. There shall be no order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
