JUDGMENT : Jaspreet Singh, J. 1.Heard learned counsel for the petitioner as well as Sri Hemant Pandey, learned Standing Counsel for the State-respondents. 2. The petitioner has come before this Court with a limited prayer that he had moved an application for mutation which has not been registered by the Tehsil Authorities. 3. Time was granted to the learned Standing Counsel to seek instructions as to why the mutation application of the petitioner has yet not been registered. 4. It has been informed that in light of the embargo contained in the U.P. Revenue Code, 2006 entertaining of the application mutation on the basis of an unregistered will is not being registered. 5. Be that as it may, the very fact that a person approaches the Court of law, no Authority cannot refuse to accept the application. It may be a different issue whether the application is maintainable or not that in that case the Court concerned can consider and pass appropriate orders on the petition but a person cannot be stopped from submitting his applications/petition as that would amount to violation of his right to seek legal redressal. 6. In this view of the matter, this Court may not deem it appropriate to keep the matter pending rather the respondent no. 2 is directed to consider, register the case of the petitioner and thereafter pass appropriate orders as may be applicable in terms of law. 7. It is made clear that the Court has not examined the plea of the petitioner and the instant order has been passed only for the purposes of registration so that the merits or demerits of the case can be considered by the court concerned. 8. With the aforesaid, the petition is disposed of.
