JUDGMENT : OM PRAKASH SHUKLA, J. (C.M. Application No. IA/15/24: Application for correction) 1. Heard Shri Upendra Nath Misra, learned Senior Advocate assisted by Shri Neel Kumar Mishra, representing the applicant/petitioner and Shri V.P. Nag, learned Standing Counsel representing the respondent/State on the instant application for correction in the judgment/order dated 09.01.2024. 2. Learned Senior Counsel representing the applicant/petitioner drawing attention to the judgment/order dated 09.01.2024, has submitted that though in 2nd and 3rd paragraph of the judgment/order dated 09.01.2024, this Court has noted the fact that the petitioner was already absorbed in the department vide order dated 29.07.1998, however, in 3rd line of 4th paragraph of the judgment/order dated 09.01.2024, it was inadvertently mentioned that the petitioner is to ‘be’ absorbed in the department of Minority Welfare. He prays that interest of justice would suffice, if the word ‘be’ mentioned in 3rd line of the 4th paragraph of the judgment/order dated 09.01.2024 is deleted and words ‘as per the terms of absorption order dated 29.07.1998’ is added after the words ‘of U.P.’ mentioned in 4th line of the 4th paragraph of the judgment/order dated 09.01.2024. 3. Learned Standing Counsel does not have any objection against the aforesaid prayer of the applicant/petitioner. 4. In view of the aforesaid, as the error in the judgment/order dated 09.01.2024 is typographical in nature, therefore, word ‘be’ mentioned in 3rd line of 4th paragraph of the judgment/order dated 09.01.2024 is deleted and words ‘as per the terms of absorption order dated 29.07.1998’ is added immediately after the words ‘of U.P.’ mentioned in 4th line of the 4th paragraph of the judgment/order dated 09.01.2024. 5. Let the aforesaid correction in the judgment/order dated 09.01.2024 be made with red ink. 6. It is clarified that judgment/order dated 09.01.2024 is corrected with the aforesaid effect only. 7. The instant application for correction is, accordingly, allowed.
