ORDER : 1. Heard Mr. A. Ganguly, learned counsel for the petitioner. Also heard Mr. S.R. Baruah, learned State Counsel for the respondent Nos.1, 3, 4 & 5, Ms. G. Hazarika, learned standing counsel for the Revenue, appearing for respondent No.2, Mr. S.S. Roy, learned CGC for respondent No.8 and Ms. S. Sarma, learned standing counsel for the Health Department for respondent Nos. 6, 7 & 9. 2. In terms of the order dated 25.09.2024, passed by this Court, Ms. G. Hazarika, learned standing counsel for the Revenue Department has placed the copy of the Notification dated 15.11.2014, which provides ex-gratia grant, inter alia, to the persons who become permanently invalid, by way of financial assistance. 3. On perusal of the Notification dated 15.11.2014, it reveals that the persons who have become permanently invalid will be provided financial assistance of Rs.3 lacs. 4. After hearing the learned counsel for the parties and on consideration of the grievance raised in this writ petition, I am of the prima facie view that the petitioner is entitled to ex-gratia grant, in terms of the above Notification dated 15.11.2014. 5. However, Mr. A. Ganguly, learned counsel for the petitioner submits that he may be heard on merit of the writ petition, as the claim of the petitioner in this writ proceeding is for payment of compensation under the public law remedy. 6. Considering the submission of learned counsel for the petitioner, let this matter be listed on 23.01.2025, as part heard. 7. A copy of the Notification dated 15.11.2014, submitted by the learned standing counsel for the Revenue Department be kept in the record and marked as “X.”
