ORDER : N.Sathish Kumar, J. Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondent to issue the certified Legal Heir Certificate of the Petitioner’s father S.P.Adaikkalam in Pa.Mu.No.8739/99/82, dated 28.12.1999 by considering the Petitioner’s representation, dated 6.6.2024. The Petitioner has filed this Writ Petition for issuance of a Writ of Mandamus directing the respondent to issue the certified Legal Heir Certificate of the Petitioner’s father S.P.Adaikkalam in Pa.Mu.No. 8739/99/82, dated 28.12.1999 by considering the Petitioner’s representation, dated 6.6.2024. 2.Mr.A.Kannan, learned Additional Government Pleader takes notice for the respondent. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. 3.It is the grievance of the Petitioner that certified copy of the Legal Heir Certificate of the Petitioner’s father S.P.Adaikkalam was issued in the year 1999. However, the files relating to the said document has been totally destroyed during Gaja cyclone. Hence the Petitioner seeks for the direction as stated supra. 4.The learned Additional Government Pleader, on instructions, submitted that the files have been destroyed during Gaja Cyclone. When the Petitioner present the xerox copy of the above said document, after due enquiry, the said certificate would be issued to the Petitioner, after proper verification. 5.In view of the above submission, the respondent is directed to issue the certified copy Legal Heir Certificate of the Petitioner’s father S.P.Adaikkalam within a period of one month from the date of receipt of a copy of this order. 6.With the above direction, the Writ Petition stands disposed of. No costs.
