ORDER : PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for a Writ of Mandamus, directing the respondents to pay the subsistence allowance from May, 2019 to the petitioner by considering the representation dated 14.07.2020. This Writ Petition has been filed seeking for a Mandamus to direct the respondents to pay the subsistence allowance to the petitioner from May, 2019, based on the petitioner's representation dated 14.07.2020. 2. It is now brought to the notice of this Court by the learned Special Government Pleader appearing for the respondents that the petitioner has now been imposed with the punishment of compulsory retirement in the disciplinary proceedings initiated against him. 3. However, according to the learned Counsel for the petitioner, for the period of the petitioner's suspension till the date of punishment order, no subsistence allowance was paid by the respondents. 4. No prejudice would be caused to the respondents if the petitioner's representation dated 14.07.2020, seeking for payment of subsistence allowance from May, 2019, till the date of punishment order is considered on merits and in accordance with law within a time frame to be fixed by this Court. 5. For the foregoing reasons, this Court directs the second respondent to pass final orders on the petitioner's representation dated 14.07.2020, seeking for payment of subsistence allowance from May, 2019, within a period of eight [8] weeks from the date of receipt of a copy of this order. 6. With the aforesaid direction, this Writ Petition stands disposed of. There shall be no order as to costs.
