[PRAYER: Contempt Petition filed under Section 11 of the Contempt of Courts Act praying this Court to punish the respondents due to their wilful disobedience of the order of this Court made in W.P(MD)No.10668 of 2023, dated 29.11.2023.] The Contempt Petition is filed seeking to punish the respondents for their wilful disobedience of the order of this Court made in W.P(MD)NO.10668 of 2023, dated 29.11.2023. 2. Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3. This Court while disposing of the above Writ Petition on 29.11.2023, clearly observed that no document was filed by the Petitioner to prove the encroachment. However, if there is any encroachment on the pathway, the Petitioner is directed to approach the authorities. 4. When the matter is taken up for hearing today, the learned Additional Government Pleader appearing for the respondents would submit that the competent authorities have redressed the grievance of the Petitioner. However, the learned counsel for the Petitioner submitted that still there is encroachment and the authorities have not taken any effective steps to remove the same. 5. A perusal of the order of this Court would reveal that there is no positive direction issued by this Court and it is also stated that the Petitioner has not filed any document in proof of encroachment. In these circumstances, this Court is of the view that no contempt is made out. Hence, the Petitioner is at liberty to work out his remedy before the appropriate forum, in the manner known to law, if so advised. 6. With the above observation, the Contempt Petition stands closed. No costs.
