ORDER : (S.M. Subramaniam, J.) : (Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of Writ of Mandamus, directing the first respondents to consider the representation of the petitioner dated 13.08.2024 in accordance with law, by Transferring the under Trial Prisoner RAGHU @ METTUR RAGHU, son of Murugesan, aged 25 years, now confined at Central Prison, Vellore, the second respondent herein to Central Prison, Salem to secure the ends of justice.) The writ of mandamus has been instituted to direct the first respondent to consider the representation of the petitioner dated 13.08.2024. 2. The learned Counsel for the petitioner would submit that the writ petitioner is the mother of the under trial prisoner now presently lodged at Central Prison at Vellore. 3. The petitioner would submit that the detenue is facing criminal cases in and around Salem District. Therefore, an application is submitted to transfer the detenue from Vellore Prison to Salem Prison. Since no action has been taken, the present writ petition came to be instituted. 4. The learned Additional Public Prosecutor would submit that the application will the processed and an appropriate decision will be taken. 5. In view of the said submission, the first respondent is directed to scrutinise the application submitted by the petitioner and taken an appropriate decision on merits and in accordance with law within a period of three (03) weeks from the date of receipt of a copy of this order. 6. Accordingly, the Writ Petition stands dismissed. No costs.
