ORDER : 1. This Writ Petition has been filed seeking for issuance of a Writ of Mandamus, directing the 1st Respondent to reissue/renew the Passport Book of the petitioner by considering his Passport Application in File No. TR1076820258124 dated 06.08.2024 on the file of the 1st Respondent. 2. It is the case of the petitioner that originally the passport was issued to the petitioner on 23.09.2014. When the petitioner has filed an application for renewal of passport, the same was not considered by the respondents. Hence, the petitioner has filed this Writ Petition. 3. It is the contention of the petitioner that in the year 2014, based on the birth certificate obtained from the Taluk Office, passport was issued. Later it was found that the said birth certificate was a fake one. Thereafter, the petitioner's applied for birth certificate and he was issued with the original/true birth certificate. Though the original birth certificate was produced for renewal of his passport, the same was not considered by the respondents. Hence, the petitioner has filed this Writ Petition. 4. The learned Senior Panel counsel appearing for the first respondent would submit that originally the passport has been issued on the basis of the false birth certificate. Though the original birth certificate has now been issued, the first respondent sought verification from the second respondent in this regard. 5. The learned Government Advocate (Crl. Side) appearing for the respondents 2 and 3, on instructions, would submit that no FIR has been filed as against the petitioner and he has not disputed the genuinity of the birth certificate now produced by the petitioner. 6 . Considering the facts and circumstances of the case, this Court is of the view that as the original birth certificate has now been produced, no criminal case is pending against the petitioner and the genuinity of the birth certificate has not been disputed, the first respondent shall consider the application of the petitioner in File No. TR1076820258124 and pass orders within a period of one month from today. 7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
