JUDGMENT : Ravindra Maithani, J. Applicant Ankita Joshi is in judicial custody in FIR No.88 of 2023, under Sections 409, 420, 120B IPC and Section 3 of the Uttar Pradesh Industrial Disputes Act, 1947, Police Station Haldwani, District- Nainital. She has sought her release on bail. 2. Heard learned counsel for the parties and perused the record. 3. According to the FIR, the applicant and the co-accused being officers in the Vision Social Society (the society) and Vidit Akshya Vision Nidyhi Ltd. Company (the company) induced various persons to invest money with the assurance of high returns, but after maturity, returns were not paid. The applicant is named in the FIR. 4. Learned counsel for the applicant would submit that she joined the company or society in the year 2017. She was a rural educated girl, who, in the search of job, came to Haldwani, and joined the company. She was initially appointed as receptionist. Subsequently, she was operating the accounts as a joint operator. In discharge of her duties, she had to issue cheques, etc. She had no hold of the business of either the society or the company. In fact, she resigned in the year 2021. 5. It is also argued that, in fact, the father of the applicant has also been duped by the officers of the company and the society, of which an FIR was lodged by her father; another co-accused has already been granted anticipatory bail. 6. Learned State Counsel admits that the applicant was an employee, but he would submit that she was a joint signatory of operating the accounts. 7. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 8. The bail application is allowed. 9. Let the applicant be released on bail, on her executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
