ORDER Per: THE ACTING CHIEF JUSTICE 1. This writ appeal has been filed against final order dated 12.6.2023 passed by learned Single Judge whereby W.P. No.7179/2023 challenging termination order of appellant dated 6.2.2023, was dismissed. 2. Learned counsel for appellant submits that principles of audi alteram partem were not followed before passing of order of termination Annexure P/3. 3. A bare perusal of the impugned order reveals that learned Single Judge has found that even if opportunity was granted then the result (termination) would not have been different and therefore grant of opportunity was a futile exercise in terms of law laid down by Apex Court in (2000) 7 SCC 529 (Aligarh Muslim University and others v. Mansoor Ali Khan) and (2002) 1 SCC 520 (Pavanendra Narayan Verma v. Sanjay Gandhi PGI of Medical Sciences and another). 4. After hearing learned counsel for appellant on the question of admission, this Court is of the view that there was a clear condition in the appointment order dated 10.4.2017 (Annexure P/1) contained in Clause 8 that services could be terminated in case of registration of an offence. 5. It is undisputed that an offence punishable under Prevention of Corruption Act has been registered against appellant. 6. In view of above, appellant cannot be helped and no illegality is found in the order of learned Single Judge. Thus, the order of learned Single Judge is upheld. 7. Consequently, writ appeal stands.
