ORDER : Leave granted. IA No. 129586/2024 and IA 129563/2024 1. The captioned applications for bail i.e. IA No. 129586/2023 in SLP(Crl) No. 10829/2023 and IA No. 129563/2023 in SLP (crl) No. 13026/2023) have been filed by the appellant/convicts. 2. The appellants unsuccessfully appealed before the High Court of Judicature at Madras against the judgment dated 23.4.2013 passed in C.C. No. 29/2005 by XI Additional Special Judge for CBI cases, Chennai, whereunder they were convicted under different section(s) of the Indian Penal Code (IPC) and Prevention of Corruption Act, 1988 (P.C. Act). The appeals were dismissed by the High Court vide common judgment dated 23.6.2023 passed in Crl. A. No. 359/2013. 3. Initially, this Court passed an order whereunder the appellants were granted exemption from surrendering. However, later, the appellants were directed to surrender and produce proof of surrender. Admittedly, in compliance of the order, both the appellants have surrendered on 1.2.2024. 4. Heard learned senior counsel for the appellants and learned senior counsel appearing for the respondent-CBI. 5. The fact that the appellant R. Gurumurthy in SLP(Crl) No. 10829/2023 was convicted under Section 120B read with Section 420 IPC, read with Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988, and sentenced to undergo rigorous imprisonment for a period of three years and he is in custody since 1.2.2024. Considering the term of the sentence imposed and the period of incarceration undergone by him, we are inclined to grant bail to him. 6. As regards the appellant R. Lakshminarasimhan in SLP(Crl) No. 13026/2023, he has been convicted under Section 120B read with Section 420 IPC, read with Section 13(2) read with Section 13(1)(d) of the P.C. Act, 1988, and sentenced to undergo rigorous imprisonment for a period of seven years. However, taking note of the fact that he is a guarantor and not an authority who sanctioned loan, though he was the then Assistant Branch Manager, we are of the view that at this point of time, he can also be granted bail. 7. Besides corporeal sentence, the appellants were also imposed with fine. 8. In that view of the matter, the applications for bail of both the appellants are allowed. The appellants are directed to be released on bail subject to the terms and conditions to be imposed by the Trial Court.
