JUDGMENT : Sanjay V. Gangapurwala, J. (Prayer: Petitions filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents to take appropriate action against illegal and unauthorised extraction of water by using Horse Power Oil Engine Motors from the Konamangalam Eri situated in Survey No.65, spread to an extent of 42 hectare and 43.5 ares, at Tindivanam Taluk, Villupuram District on the basis of the representation of the petitioner dated 29.6.2018 and consequential memo of the second respondent in Na.Ka.No. A6/1469/2018, dated 25.10.2018.) 1. Heard Mr.R.D.Ashok Kumar, learned counsel appearing for Mr.S.N.Ravichandran, learned counsel for the petitioner; and, Mr.K.Karthik Jegannath, learned Government Advocate for the respondents. 2. Learned Government Advocate submits that the encroachment has been made on the lake by various persons, including the petitioner. Notices under Sections 7 and 6 of the Tamil Nadu Land Encroachment Act, 1905 have already been issued. Now the crops are standing. After harvest, the entire encroachment would be removed. The persons are drawing water for their agricultural crops. The encroachments would be removed within three months. 3. We accept the statement of learned Government Advocate that within three months the entire encroachment would be removed and drawing of water would be completely stopped. In view of the said statement, the writ petition is disposed of. There shall be no order as to costs.
