JUDGMENT : (P.B. Bajanthri, J.) Ref: I.A. No. 01 of 2019 Heard I.A. No. 01 of 2019 for condonation of delay. There is a delay of about 78 days in filing L.P.A. No. 737 of 2019. For the reasons stated in the application read with the affidavit, delay of about 78 days in filing L.P.A. No. 737 of 2019 stands condoned. 2. Accordingly, I.A. No. 01 of 2019 stands allowed. 3. With the consent of the learned counsels for the respective parties, L.P.A. No. 737 of 2019 is taken up for final disposal. 4. Appellant has assailed the order of the learned Single Judge dated 05.03.2019 passed in C.W.J.C. No. 5707 of 2015. Core issue involved in the present lis is whether appellant is entitled to be transferred/shifted to Collectorate Establishment under the State Government of Bihar from District Rural Development Authority (for short DRDA). Among others, Appellant was working in DRDA. State Government took a policy decision on 27.07.2009 insofar as considering such of those employees in DRDA to be shifted to the Collectorate Establishment under the State Government of Bihar.

Further, we have noticed Annexure-1, two of the employees of DRDA were shifted from DRDA to Collectorate Establishment under the State Government of Bihar in the light of State Policy, cited supra, on the other hand, appellant’s case was not considered. 6. The learned Single Judge has not apprised that appellant has been discriminated insofar as shifting his services from DRDA to Collectorate Establishment under the State Government of Bihar on par with others (vide Annexure-1). If the appellant’s services were shifted from DRDA to Collectorate Establishment under the State Government of Bihar, in that event, he would have entitled to certain service and monetary benefits in the Collectorate Establishment under the State Government of Bihar. Discrimination issue has not been appraised by the learned Single Judge in the manner known to the law. 7. Recently, Hon’ble Supreme Court in the case of The State of Madhya Pradesh & Ors. vs. Shyam Kumar Yadav & Anr. (Petition(s) for Special Leave to Appeal (C) No(s). 25609 of 2018) decided on 22.07.2024 held that there should not be a discrimination insofar as regularization is concerned. The aforementioned principle laid down by the Hon’ble Supreme Court aptly applicable to the case in hand. Therefore, the concerned Respondent/Competent Authority has to revisit the grievance of the petitioner and redress the same on par with names of two persons reflected in Annexure-1 to the Writ petition namely Bhim Shankar, Ajit Kumar Singh and Akbar Ali. 8. Accordingly, appellant has made out a case so as to interfere with the order of the learned Single Judge dated 05.03.2019 passed in C.W.J.C. No. 5707 of 2015 and it is set aside. Matter is remanded to the competent authority to take decision to the extent that there is a discrimination among the employees of the then DRDA and set right the same, thereafter, extend all certain service and monetary benefits on par with the aforementioned persons. The above exercise shall be undertaken within a period of three months from the date of receipt of the order. 9. With the above observation, L.P.A. No. 737 of 2019 stands allowed.
