JUDGMENT : Heard. 2. Petition has filed this petition seeking the following reliefs: "(i) to issue writ order or direction in the nature of mandamus commanding the opposite parties no. 2 and 3 to register a case against the authorities and employees of opposite parties no. 4 under the relevant sections of I.P.C. and further to get the tractor registration no. UP30AX5332, SWARAJ 735 FE, bearing tractor Model No. SWARAJ 735 FE, Chassis No. MBNAJ28AEKTF09471 and Engine No. 1354/KF005763, released from illegal custody of the opposite party No. 4 in favour of the petitioner. (ii) to issue writ order or direction in the nature of mandamus commanding the opposite party No. 4 to ensure the implementation of law provided by Civil Procedure Code and Banks and Financial Institution Act 1993 and Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 read with the Security Interest (Enforcement) Rules, 2002." 3. If there is a cause, petitioner may lodge an F.I.R. or if is not being lodged, take recourse to Section 156 (3) Cr.P.C. or file a complaint, as the case may be as per law. 4. With these observations, petition is disposed of without entering into merits of the allegations/averments made in the writ petition.
