JUDGMENT : 1. Heard Sri Krishna Kumar Singh, learned counsel for petitioner as well as learned Standing Counsel for respondents. 2. It has been submitted by learned counsel for petitioner that petitioner had made an application for grant of arms license on 31.01.2013 before the District Magistrate, Hardoi and till date the same has not been decided. Accordingly, a prayer has been made for a direction to the District Magistrate, Hardoi decide the application of the petitioner for grant of arms license expeditiously. 3. Learned Standing Counsel on the basis of instructions received from District Magistrate, Hardoi has informed this Court that the application of the petitioner has already been rejected by order dated 24.08.2013 considering the police report submitted in this regard. It is stated that immediately on the date when the application was rejected, the petitioner again submitted fresh application for grant of arms license which could not be processed in light of the fact that previous application has already been rejected. 4. Against the order of rejection neither petitioner has challenged the same in appeal nor before this Court consequently the said issue has become final. It is submitted that subsequently the Arms Rule of 2016 have come into operation and in any case a previous application moved in 2013 cannot be considered today and in case petitioner is desirous to obtaining firearms license, he is at liberty to move a fresh application under new Rules. 5. It is in the aforesaid circumstances, this Court is of the considered view that the prayer sought by the petitioner for a direction to the respondents to decide his pending application cannot be granted as his application already stands rejected. 6. Subject to the aforesaid observations, there is no merit in the writ petition which is accordingly dismissed.
