JUDGMENT : Today, when the matter is taken up for hearing, the learned counsel for the appellant seeks permission of this Court to withdraw the present Criminal Appeal with a liberty to file an Appeal before the Sessions Court as per proviso to Section 372 Cr.P.C. 2. Granting liberty, as sought for, the present Criminal Appeal is dismissed as withdrawn. 3. Registry is directed to return the certified copies to the learned counsel for the appellant under proper acknowledgment. Miscellaneous applications pending, if any, shall stand closed in consequence.
