ORDER : This criminal petition, under Sections 437 and 439 Cr.P.C., is filed by the petitioner-accused No. 4 seeking to release him on bail in crime No. 27 of 2024 of Narsipatnam Rural Police Station, Anakapalli District, registered for the offence punishable under Sections 20 (b) (ii) (C) and 25 read with Section 8 (c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Heard Sri Kakumanu Joji Amrutha Raju, learned counsel appearing for the petitioner-accused No. 4, and learned Assistant Public Prosecutor appearing for the respondent-State. 3. Case of the prosecution in brief is that on 31-01-2024, the Sub Inspector of Police, Narsipatnam Rural Police Station, on credible information, along with his staff and mediators rushed to Nellimetta Junction and found one white colour car and some persons loading Ganga bags. The Sub Inspector of Police apprehended the petitioneraccused No. 4 and found 46 K.Gs. of Ganja in the said vehicle. After conducting panchanama and after seizing the contraband, the Sub Inspector of Police arrested the petitioner-accused No. 4 and remanded him to judicial custody. 4. Learned counsel for the petitioner-accused No. 4 submits that the petitioner-accused No. 4 was arrested on 31-01-2024 and ever since, he has been in judicial custody and that though statutory period of 180 days is over, the police have not filed charge sheet and as such, the petitioner-accused No. 4 is entitled to be released on bail. 5. On the other hand, learned Assistant Public Prosecutor, on instructions, confirms the factum of non-filing of charge sheet even after expiry of statutory period. 6. In view of the above facts and circumstances of the case, this Court is inclined to enlarge the petitioner-accused No. 4 on bail with certain conditions. 7. The petitioner-accused No. 4 is, therefore, ordered to be released on bail on his executing a personal bond for Rs.50,000/- with two sureties for the like sum each to the satisfaction of learned Additional Judicial I Class Magistrate, Narsipatnam. After release, the petitioner-accused No. 4 is directed to appear before the Station House Officer, Narsipatnam Rural Police Station, twice in a week i.e. on every Monday and Thursday between 10 a.m. and 5 p.m. until further orders. 8. The criminal petition is accordingly allowed.
