Order : (KULDEEP MATHUR, J.) This second application for bail under Section 483 BNSS has been filed by the petitioner who has been arrested in connection with F.I.R. No.165/2024 registered at Police Station Nimbahera Sadar, Dist. Chittorgarh, for the offences under Sections 8/15 and 8/29 of NDPS Act. 2. Learned counsel for the petitioner submitted that the allegation against the present petitioner is that he was escorting the pick up vehicle having registration No.HR-66-B-8501, loaded with contraband (poppy husk/straw) weighing 328 Kgs 900 Gms. As per the prosecution, co-accused persons namely Bhaga Ram and Rama Ram Vishnoi who were transporting the contraband in the offending vehicle fled away from the place of incident upon seeing the police personnels. 3. Drawing attention of the Court towards the statements of the Seizure Officer- Sanjay Sharma and Investigating Officer- Ram Sumer recorded before the competent criminal Court, learned counsel submitted that the statements of the Seizure Officer and the Investigating Officer are sufficient proof of the fact that the petitioner has been made an accused in the present case solely on the basis of suspicion without there being any direct evidence available against him on record. 4. Lastly, learned counsel submitted that the petitioner is in judicial custody; the petitioner does not have any criminal antecedents and the trial of the case will take sufficiently long time, therefore, the benefit of bail may be granted to the accused-petitioner. 5. Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record. 10. Having considered the rival submissions, facts and circumstances of the case, this Court prima facie finds that the allegation against the present petitioner is that he was escorting the offending vehicle loaded with contraband greater than commercial quantity. The contraband was not recovered from the conscious and exclusive possession of the present petitioner. The Seizure Officer and the Investigating Officer during their cross- examination have admitted that no direct evidence establishing connection of the petitioner with offending vehicle or recovered contraband was made a part of the record. This Court further prima facie finds that the petitioner does not have any criminal antecedents. The twin conditions enumerated under Section 37 of the NDPS Act are duly satisfied in the present case. Thus, without expressing any opinion on merits/demerits of the case, this Court is inclined to enlarge the petitioner on bail. 11. Consequently, the second bail application under Section 483 BNSS is allowed. It is ordered that the accused-petitioner Baburam S/o Omaram Anjana (Patel) arrested in connection with F.I.R. No.165/2024 registered at Police Station Nimbahera Sadar, Dist. Thus, without expressing any opinion on merits/demerits of the case, this Court is inclined to enlarge the petitioner on bail. 11. Consequently, the second bail application under Section 483 BNSS is allowed. It is ordered that the accused-petitioner Baburam S/o Omaram Anjana (Patel) arrested in connection with F.I.R. No.165/2024 registered at Police Station Nimbahera Sadar, Dist. Chittorgarh, shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of Rs.1,00,000/- and two sureties of Rs.50,000/- each, to the satisfaction of learned trial court, for his appearance before that court on each & every date of hearing and whenever called upon to do so till completion of the trial. 12. It is however, made clear that findings recorded/observations made above are for limited purposes of adjudication of bail application. The trial court shall not get prejudiced by the same.
