ORDER : Venkata Jyothirmai Pratapa, J. This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the respondent No.1 in interfering with the civil dispute pending between the petitioner and respondent Nos.4 to 6 in respect of the house admeasuring 132.1 Sq.yds in R.S.No.43 bearing D.No.61-10/3-45, Raghu street, Ramalingeshwara Nagar, Vijayawada, Krishna District which is the schedule property in I.A.No.7/2021 in O.S.No.60/2021 & I.A.No.8/2021 in O.S.No.61/2021 on the file of the II Addl. Junior Civil Judge Court, Vijayawada and trying to adjudicate the civil dispute of specific performance of contract as arbitrary, illegal and beyond jurisdiction and consequently direct the respondent No.1 not to interfere with the civil dispute pending between the petitioner and respondent Nos.4 to 6 in respect of the house admeasuring 132.1 Sq.yds in R.S.No.43 bearing D.No.61-10/3-45, Raghu street, Ramalingeshwara Nagar, Vijayawada, Krishna District without following due process of law in the interest of justice…” 2. Heard Sri P.Nagendra Reddy, learned counsel for the petitioners and Sri V.Farook, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioners would submit that the Police are interfering in the civil dispute between the petitioners and the unofficial respondents. 4. Learned Assistant Government Pleader for Home would submit that in the light of the interim orders passed by this Court, the Police are not interfering in the civil dispute between the parties. 5. Recording the same, the Writ Petition is disposed of. However, the Police are directed not to interfere in the civil dispute between the parties except under due process of law. No costs. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
