ORDER : 1. Leave granted. 2. Heard the learned senior counsel appearing for the appellant and the learned counsel appearing for the respondent-State. 3. The learned counsel appearing for the respondent states that in terms of the impugned order, the case of the appellant was considered by the Sentence Review Board in its meeting dated 23rd February, 2024. 4. However, we find that the Sentence Review Board has not considered the fact that the co-accused in the case have been granted the benefit of premature release as noted in paragraphs 4 and 5 of the impugned order of the High Court. 5. As this important fact mentioned in the impugned order has not been noted by the Sentence Review Board, we direct that the case of the appellant shall be again placed for reconsideration before the Sentence Review Board in the next meeting along with a copy of the order passed in the case of the co-accused. Appropriate decision shall be taken by the State within a maximum period of three months from today. 6. The appeal is accordingly disposed of on the above terms.
