ORDER : 1. The transfer petition has been filed by the petitioner-wife seeking transfer of the Original Suit filed by the respondent-husband for dissolution of marriage under Section 13 of the Hindu Marriage Act, 1955, being Original Suit No. 3026 of 2023 pending in the Court of the Principal Judge, Family Court, Kanpur City, U.P. to the Court of Principal Judge, Family Court, West Midnapore District Court, Aurobindo Nagar Midnapur, West Bengal. 2. Pending the proceedings, the matter was referred to the Mediation for exploring the possibility of settlement and the parties have amicably settled their disputes by entering into the Settlement Agreement dated 25.11.2024, which reads as under: - "1. Both the parties hereto have arrived at an amicable mutual settlement on the following terms and conditions:- i. Both the parties hereto confirm and declare that they have, voluntarily and of their own free will, decided to resume their marital life as husband and wife. ii. The Petitioner-wife undertakes to end the existing dispute and live together as husband and wife and respect for each other. iii. Both the parties have also agreed to forgive and forget past differences and start their life afresh and henceforth live peacefully and happily. iv. It is further agreed between the parties that the Respondent- husband shall bring his wife in the month of December, 2024 or January 2025, to the matrimonial home or any other place as mutually be decided by the parties. v. The Respondent-Husband has decided to deposit the amount as per the choice for the maintenance of his son in the account of Petitioner bearing Account No. 619802010012396 IFSC Code - UBIN0561983, Union Bank of India, Samband Community Hall Malancha Road, Kharagpur, Dist. Paschim Medinipur, West Bengal. vi. Both the parties undertake to give due respect to each other and maintain dignified behaviour towards each other and their respective families. vii. Subject to the aforesaid terms, the parties have resolved all their disputes amicably and have agreed that they will not have any further grievances against each other or their respective family members. viii.

Both the parties hereby undertake to fulfill all matrimonial obligations and responsibilities once the Respondent-husband brings back his wife and they will cooperate each other for the Transfer of the Petitioner from Calcutta to the District Kanpur, U.P. or any other place as mutually may be decided by both the parties in future, and both parties have agreed to cooperate the exchange of the required document asked by department of both parties in the Transfer of the Petitioner from the working place at Calcutta to the District Kanpur, Uttar Pradesh or any other place. 2. The following cases pending between the parties is as under: - i. Case No. 3026 of 2023 under Section 13 H.M.Act, pending before Principal Judge, Family Court, 1 Kanpur Nagar Uttar Pradesh filed by the Petitioner. 3. It is also agreed between the parties that Respondent shall withdraw the case as mentioned in Para-2 filed by the Respondent herein and shall take all steps to put an end to all civil/ criminal litigation existing between the parties within a period of one month after the disposal of the present transfer petition by the Hon'ble Supreme Court. 4 .This agreement has been executed by both the parties out of their freewill and without any coercion, duress or collusion. The parties hereby undertake to abide by the terms and conditions set out in the above-mentioned Agreement. 5 .The said agreement has been explained to the parties in vernacular and they have understood the same." 3. The above agreement has been signed by the concerned parties and their respective Advocates as well as the Mediator. In view of the above settlement, the parties have agreed that the respondent shall withdraw the case mentioned in para 2 of the Settlement Agreement, filed by the respondent, and take all steps to put an end to all civil/criminal litigation existing between the parties within one month after the disposal of the present petition. 4.
