ORDER : YARENJUNGLA LONGKUMER, J. 1.This application under order 1 Rule 10(2) of the CPC has been filed by the appellant/applicant praying for impleadment of Nos. 1. Miss. Kitiyala, 2. Mr. Medemchuba and 3. Miss. Imnali in MACApp./5/2025. 2. The learned counsel for the applicant/appellant submits that the three persons; Miss. Kitiyala, Mr. Medemchuba and Miss. Imnali are necessary parties in the MACApp./5/2025 but due to inadvertence the said persons were not impleaded as party respondents in the appeal. Having realized that the appeal cannot be properly adjudicated without impleading the necessary parties, the applicant herein has preferred the instant I.A seeking leave of this Court to allow the appellant to implead Miss. Kitiyala, Mr. Medemchuba and Miss. Imnali, as respondent Nos. 4, 5 and 6 in MACApp./5/2025. 3. This Court has observed that before the member MACT, Mokokchung in MACT Case No. 32/2022 against which the MACApp./5/2025 has been filed, the person sought to be impleaded as respondent Nos. 4, 5 and 6 are also the petitioners/claimants Nos. 2, 3 and 4. Therefore, it is necessary that the parties who were petitioners/claimant before the MACT, Mokokchung should be impleaded as parties in the present appeal. 4. Accordingly, this Court is of the view that interest of justice will be served by allowing this application. 5. The appellant/applicant is allowed to implead the said persons Nos. 1. 6. Miss. Kitiyala, 2. Mr. Medemchuba and 3. Miss. Imnali, as respondents Nos. 4, 5 and 6 in the MACApp./5/2025. 7. The appellant/applicant shall file the amended cause title within a period of 1(one) week. 8. List the matter after 1(one) weeks for hearing on the I.A.(Civil)/54/2025 and I.A.(Civil)/55/2025.
