JUDGMENT : 1. When the case is taken up today, the counsel on either side submitted that the issue is covered by the judgment of the Division Bench of this Court in O.P. (KAT) No. 438 of 2022 and W.P. (C) No. 35141 of 2023 , which is rendered considering the Division Bench decision. It is submitted that the directions contained in the judgment in W.P. (C) No. 35141 of 2023 can be issued in these cases also. 2. The learned Single Judge disposed of W.P. (C) No. 35141 of 2023 in the following terms: “18. I find that as on date, the issue agitated by the petitioners in this writ petition is covered by the Division Bench judgment of this Court in O.P. (KAT) No. 438 of 2022. Therefore, the writ petition is disposed of with the following directions: (i) The Government shall re-fix the pension of the petitioners within a period of three months from the date of receipt of a copy of this judgment by adopting an appropriate scale/enhancing DA appropriately, ensuring that such pension is not lesser than the pension received by the employees who retired prior to 01.07.2019 and after 01.04.2020. (ii) The petitioners would be entitled to consequential benefits together with arrears of pension, which the respondents shall pay within a period of three months from the date of receipt of a copy of this judgment, together with interest at the rate of 6% per annum.” 3. The above directions will hold in the case of the petitioners as well. 4. These writ petitions are disposed of in terms of the said directions.
