ORDER : 1. The matter comes up on an application (inward no.01/2025) for taking on record certain documents and releasing the appellant-applicant on personal bond only while waiving the condition of furnishing two sureties of Rs.20,000/- each. 2. Vide order dated 02.09.2022, this Hon’ble Court has allowed the application for suspension of sentence in D.B. Criminal Misc. Suspension of Sentence Application No.270/2022. The only reason why such order could not be given effect to was that two sureties of Rs.20,000/-, which was a condition, could not be fulfilled. Earlier also, the appellant-applicant moved an application bearing No.01/2023 to modify the condition of two sureties of Rs.20,000/- and releasing the appellant-applicant on personal bond in a sum of Rs.40,000/- only; the same was rejected by this Hon'ble Court while taking note of the fact that the learned counsel for the appellant was convinced that the appellant-applicant was suffering from mental ailment and her family members were not ready to accept her, and there was no reason for her to come out of jail, therefore, he did not want to press the application (IA No.01/2023). 3. The medical examination report is also brought on record dated 01.05.2025, which reads as under:- “Convict Prisoner Sarika @ Pinky W/o Kanti Lal, age 53 years of Open Camp Sanganer Jaipur. As per Record Inmate not taking any type of Psychiatric Medicines sing long time of period. Inmate behavior and orientation (TPP) is normal, On Evaluation her mental and physical health is stable and satisfactory.” 6. Leaned counsel for the appellant-applicant submits that the appellant-applicant is an open air camp and by doing some small jobs, she will be able to earn her livelihood. He further submits that the doctors' report and authorities report shows her medical condition is normal and she is not undergoing any kind of treatment. 8. This Court took note of the fact that the application No.01/2023 was dismissed as not pressed at the instance of learned counsel for the appellant-applicant while keeping into consideration that the mental ailment did not make any reason why the appellant-applicant could be set free and probably could not be cared for. 9. The sum and substance of the issue is that the sentence of the appellant-applicant was suspended by this Hon'ble Court on 02.09.2022, but due to the non-fulfillment of the condition of two sureties of Rs.20,000/-, she is still behind bars and has undergone an actual custody of 11 years, 02 months and 15 days and total custody of 12 years, 02 months and 27 days (with remission). 10. This Court, looking into the very peculiar circumstances of the case and the reasons mentioned in the application, is inclined to allow the present application. Accordingly, the condition of two sureties of Rs.20,000/- imposed in D.B. Criminal Misc. Suspension of Sentence Application No.270/2022 on 02.09.2022 is waived and the appellant-applicant shall be released upon furnishing personal bond in the sum of Rs.40,000/- only. Accordingly, the condition of two sureties of Rs.20,000/- imposed in D.B. Criminal Misc. Suspension of Sentence Application No.270/2022 on 02.09.2022 is waived and the appellant-applicant shall be released upon furnishing personal bond in the sum of Rs.40,000/- only. The appellant-applicant shall be required to appear before this Hon’ble Court on 03.07.2025 and whenever ordered to do so. All the other conditions imposed vide order dated 02.09.2022 shall remain the same.
