JUDGMENT : 1. Counsel for the respondents seeks further time for filing a counter affidavit on behalf of Principal Secretary, Department of Health. 2. This writ application has been filed on 5.10.2024 and on 19.11.2024 notice was issued to all the respondents and notice was accepted by Mr. Mohan Kumar Dubey, A.C. to learned A.G. on that date. 3. It is sad that till now, the Principal Secretary, Department of Health has not chosen to file a counter affidavit to meet the petitioner’s contention that in spite of an order passed by Division Bench of this Court on 8.12.2023 In W.P.(C) 671 of 2021, the respondents have issued the subject tender without giving any exemption to MSMEs. 4. The counter affidavits filed by other respondents do not deal with this contention. 5. Therefore, notice be issued to respondents 6 to 30 to show cause why proceedings for contempt of Court shall not be initiated against them for willful disobedience of the order dt. 8.12.2023 passed in WP (C) No. 671 of 2021. 6.
