ORDER : 1. Petitioner is arrayed as accused in almost 1000 crimes registered against the Office Bearers of the BSNL Employees Co-operative Society Ltd., alleging breach of trust, misappropriation and cheating. The petitioner was granted bail in some of the crimes as per Annexures A2 to A229 orders, subject to conditions. As per Condition No.2, the petitioner has to appear before the Investigating Officer between 10 and 12 Noon on every Saturday till the final report is filed. Condition No.4 prohibits the petitioner from leaving the jurisdiction of the Court without permission. This Crl. M.C. is filed seeking deletion of Condition Nos.2 and 4 in Annexures A2 to A229 orders. 2. The learned Counsel for the petitioner submitted that a condition akin to Condition No.4, imposed while granting bail to one among the other accused, was subsequently lifted by Annexure A233 order. It is hence prayed that similar benefit may be extended to the petitioner also. 3. Per contra, the learned Public Prosecutor contended that gravity of offences should be taken into account while considering the request for deletion of conditions. It is pointed out that final reports are filed only in 113 cases and investigation is not yet complete in the other crimes. 4. As pointed out by the Counsel for the petitioner, Condition No.2 in Annexures A2 to A229 orders, requiring the petitioner to appear before the Investigating Officer on all Saturdays till filing of final report is rendered otiose with the filing of the final report. Therefore, no separate order need be passed with respect to Condition No.2. As far as Condition No.4 is concerned, an identical condition imposed by this Court while granting bail to another accused having been lifted by Annexure A233 order, the same benefit ought to be extended to the petitioner also. 5. Therefore, the Criminal Miscellaneous Case is disposed of by deleting Condition No.4 in Annexures A2 to A229 orders. Needless to say, the petitioner shall appear before the Investigating Officer as and when directed and shall furnish his address and contact details, whenever he leaves the State.
