ORDER : 1. Leave granted. 2. The National Peoples Party is aggrieved by an order dated 20.03.2019 passed by the Speaker of the 13th Nagaland Legislative Assembly in the matter bearing No.AS/LC-23/MERGER/2019, whereby the Speaker declared merger of respondent nos.2 and 3 with respondent no.4 – Political Party, namely, Nationalist Democratic Progressive Party (NDPP). 3. Learned senior counsel/counsel for the parties fairly state that elections to the 13th Nagaland Legislative Assembly were held on 27.02.2018 and the result was declared on 05.03.2018. The term of that Legislative Assembly has expired and fresh Assembly elections have been held in February/March 2023. We are, thus, satisfied that the issues, which are otherwise of paramount importance, pertaining to the powers exercisable by a Speaker within our constitutional framework, have been rendered academic. 4. Consequently, the appeal is disposed of as having become infructuous. All the questions of law raised in this appeal are kept open, to be gone into in an appropriate case.
