ORDER : 1. In this petition, the petitioners seek the following reliefs: i) Issue a writ of mandamus directing the respondent to approve the admission of the petitioner students 2 and 3 for 2 nd year B-Pharma Course; ii) Issue a writ in the nature of mandamus directing the respondent to accept the examination fee and issue hall ticket and direct the respondent to permit the petitioner students 2 and 3 to take up the 3 rd semester B-Pharma Course scheduled to commence from 25.04.2025 vide Annexure-F. iii) Issue any writ or order as deemed fit by this Hon’ble Court in the circumstances of the case, in the interest of justice and equity. 2. Heard learned counsel for the petitioners, learned counsel for the respondent and perused the material on record. 3. A perusal of the material on record would indicate that on 10.02.2025, the respondent-University issued a revised notification, publishing revised calendar of events for admission for academic year 2024-25 to Second Year B.Pharma Course (Lateral Entry), M.Pharma and Pharma D (Post Baccalaureate) Courses for the academic year 2024-25, by notifying the same as per Annexure-‘R1’, which reads as under: “RAJIV GANDHI UNIVERSITY OF HEALTH SCIENCES, KARNATAKA, BENGALURU 4 TH T BLOCK, JAYANAGAR, BENGALURU-560 041. Ref No.RGUHS/AC2-ADM/COE/2024-2025 Date: 10.02.2025 REVISED NOTIFICATION-II Sub: Revised Calendar of Events for Admission for Academic Year 2024-25 Ref: Ref No: RGUHS/AC2-ADM/COE/2024-2025, dated 09.10.2025 Revised Calendar of Events for admission to 2 nd Year B.Pharm Course (Lateral Entry), M.Pharm & Pharm D (Post Baccalaureate) Courses for the academic year 2024-25 is hereby notified as follows: Note: Online entry for Lateral entry for (2 nd B.Pharm) admissions limit as per RGUHS notification and Notification issued vide ref no.RGU/Auth/168 th Syndicate/151/2021-22 dated: 05.05.2022. Ref No.RGUHS/AC2-ADM/COE/2024-2025 Date:10.02.2025 Note: 1. The admitting college should have been notified as affiliated to the University with permission to admit students for the concerned course for the year 2024-25 before the last date of admission. 2. Request for correction of name in the online admission statement will not be entertained. Entry of names in the online admission statement, by itself does not vest the right of admission approval. Number and the name of students uploaded in the online admission statement and email must match with each other and shall not exceed the number of sanctioned intake. Any excess admissions beyond the approved intake will be rejected. 3.

If any of the above dates in Calendar of events happens to be holiday, the following Working day shall be taken into consideration except for payment of fee and fine which is available through online payment. 4. Admission Register shall contain the date, amount and number of the receipt corresponding to the name of the student with the signature of the student. Admission of those Students who have not paid the admission fees in full will not be approved. 5. If any student's, name's could not be uploaded in the online portal on or before last date due to any technical or whatever reasons the same can be intimated till midnight (11.59 PM) on the last date to RGUHS by sending email to Registrar/Hon'ble Vice Chancellor. The name of students in bold letters mentioning the reason for considering their admissions, any request for admission shall not be considered after the last date. 6. Date of verification of documents for admission approval will be intimated to the college by the university. The Principal and the concerned officials of the college must be present on the specified date and time without fail with any other document that they may wish to submit, University will go ahead with verification of documents pertaining to their college even in their absence. 7. No Correspondence regarding deficient documents except during verification. Principal is expected to keep track of the deficiencies and fulfill them well before the last date prescribed without any prompting 8. Principal of the institutions should download admission approval of students and display the same in the college notice board and website and discharge all disapproved students immediately. The University shall not entertain any further correspondence from anybody regarding disapproved students. 9. Exact dates of commencement of Theory & Practical examinations and date of declaration of results will be notified by the Registrar (Evaluation) separately. 10. Submission of Eligibility Certificates is mandatory of all the candidates' i.e. Foreign/NRI/Non Karnataka admitted for the academic year 2024-25 along with their other original documents.

In pursuance of the same, petitioner No.1 attempted to upload the admissions of two students, namely, Varshita and Kavya, but could not succeed because of a certain technical glitch. The email correspondence in this regard is produced by the petitioner No.1 at Annexures-C, C1, C2 and C3 respectively. So also, a request made by the petitioner to open online portal for lateral entry on 25.02.2025 is produced at Annexure-D to the petition. Thereafter, petitioner No.1 also paid the admission fee on 27.02.2005, six days after 21.02.2025, as stipulated in the aforesaid notification. However, on 06.03.2025, the admission register of the petitioner No.1 for having admitted the aforesaid two students has been certified by the respondent / Rajiv Gandhi University of Health Sciences, Bengaluru (for short ‘RGUHS’), whose seal is found in the original admission register produced by the petitioner No.1 before this Court. 5. It is pointed out that apart from the aforesaid two students, petitioner No.1 has neither admitted any other student nor intended to admit any other student by way of lateral entry to the Second Year B-Pharma Course and the petitioner does not intend to take any other student in respect of M-Pharma, Pharma D (Post Baccalaureate) Courses for the academic year 2024-25 and in the light of the interim order passed by this Court, the petition may be disposed of directing the respondent to grant approval in relation to only those two students. 6.
6. Per contra, learned counsel for the respondent would oppose the petition and submits that the same is liable to be dismissed. 7. On 24.04.2025, this Court passed the following interim order:- “Smt. Mamatha Kulkarni, learned counsel is directed to accept notice for the respondents. Copies to be served. In the meanwhile, by way of an interim arrangement and without prejudice to the rights and contentions of the parties and making it subject to the final outcome of the petition and condition that the petitioner shall not claim any equities in this regard, respondent-University is directed to permit petitioner Nos.2 and 3 to take up 3 rd Semester B Pharma examination scheduled to commence on 25.04.2025. Re-list after Summer Vacation, 2025. Hand delivery of this order is permitted.” 8. Thereafter, on 10.10.2025, this Court passed further interim order:- “ORAL ORDER on I.A.No.2/2025 I.A.No.2/25 is filed by the petitioners seeking the following reliefs: "(i) Issue a writ in the nature of Mandamus directing the respondent Rajiv Gandhi University of Health Sciences, to approve the admissions of Petitioners 2 & 3 for second year B Pharma Course. (ii) Issue a writ in the nature of mandamus directing the respondent to accept the examination fee and issue hall ticket and the direction the respondent to permit the petitioner student 2 & 3 to take up the 3 rd semester B-Pharma Courses scheduled to commence from 25.04.2025 vide Annexure-F. (iii) Issue any writ or order as deemed fit by this Hon'ble Court in the circumstances of the case, in the interest of justice and equity." Under identical circumstances in relation to the third semester, B-Pharma examination which commenced on 25.04.2025, this Court passed the following interim order on 24.04.2025: "Smt. Mamatha Kulkarni, learned counsel is directed to accept notice for the respondents. Copies to be served. In the meanwhile, by way of an interim arrangement and without prejudice to the rights and contentions of the parties and making it subject to the final outcome of the petition and condition that the petitioner shall not claim any equities in this regard, respondent – University is directed to permit petitioner Nos.2 and 3 to take up 3rd Semester B Pharma examination scheduled to commence on 25.04.2025. Re-list after Summer Vacation, 2025.

In view of the aforesaid factual circumstances and identical order passed on 24.04.2025, by way of an interim arrangement and without prejudice to the rights and contentions of the parties and making it subject to the final outcome of the petition and the condition that the petitioners shall not claim any equities in this regard, respondent -University is directed to permit petitioners No.2 and 3 to take up the 4th semester B-Pharma examinations scheduled to be commence from 13.10.2025. Re-list this matter on 03.11.2025. Hand delivery of the order is permitted.” 9. In view of the aforesaid facts and circumstances and the fact that the fees in relation to two students has been paid by the petitioner No.1, in respect of whom admission register has been certified by the respondent, as could be seen from the original admission register, having regard to the peculiar/unique/special facts and circumstances obtaining in the instant case and by directing that this order shall not be treated as a precedent nor shall carry any precedential value for any purpose whatsoever, especially in the light of the interim orders passed by this Court, I deem it just and appropriate to dispose of the petition by issuing certain directions. 10. In the result, I hereby pass the following: ORDER: i) The Writ Petition is hereby disposed of. ii) The respondent is directed to grant approval in favour of the petitioner No.1 - Institution in respect of only two students, namely, Varshita and Kavya for lateral entry to the Second Year B-Pharma Course for the academic year 2024-25. iii) It is made clear that the present order is passed in the peculiar/unique/special facts and circumstances obtaining in the instant case and the present order shall not be treated as a precedent nor shall it carry any precedential value for any purpose whatsoever.
