ORDER : 1. Heard learned counsel for the parties on the application preferred on behalf of the applicants for modification of the order dated 09.01.2025 passed by this Court. 2. Learned counsel for the applicants submits that in the concluding portion of the order dated 09.01.2025, this Court has passed an order that the application preferred on behalf of the petitioners under Order 41 Rule 21 read with Section 151 of the CPC be expeditiously decided within a period of eight weeks from the date of receipt of certified copy of this order, “in accordance with law after hearing all the parties”. 3. Learned counsel for the applicant further submits that there are more than 114 respondents in the matter and the appeal has been filed only by the respondent Nos.1 to 5, therefore, they are contesting party before the Board of Revenue, thus, the concluding para of order dated 09.01.2025 may be modified and instead of “in accordance with law after hearing all the parties”, the same may be substituted by “in accordance with law after hearing the respondent Nos.1 to 5(appellants before the Board of Revenue).” 4. Learned counsel for the respondent Nos.1 and 5 are not in a position to refute the submissions made by the learned counsel for the applicants. 5. In view of the submissions made before this Court, the present writ misc. application is allowed and the order dated 09.01.2025 passed by this Court is modified and the concluding para of the order dated 09.01.2025 now be read as under:- “Therefore, in view of above, the present writ petition is disposed of with a direction to the Board of Revenue, Ajmer to take up the matter for hearing and decide the same on the application preferred by the petitioners under Order 41 Rule 21 read with Section 151 of CPC expeditiously preferably within a period of eight weeks from the date of receipt of certified copy of this order, “in accordance with law after hearing the respondent Nos.1 to 5(appellants before the Board of Revenue).”
