body2025
JUDGMENT : This W.P. (PIL) is filed by the petitioner seeking construction of the District Prosecution Offices in every Civil Court campus in the State of Jharkhand pursuant to a Memo No.1832 dt. 26.07.2017 issued by the then Chief Secretary of the Government of Jharkhand. He also seeks certain directions for taking up steps for betterment of facilities for witnesses as well as victims pursuant to another Memo No. 761 dt. 26.02.2013 and a follow up Memo No. 2585 dt. 22.06.2013. 2. As regards construction of the District Prosecution Offices is concerned admittedly Public Prosecutors are engaged by the State Government for prosecuting accused in criminal courts. If the State intends to provide better facilities for Prosecutors they are welcome to do so subject to availability of space in the court compounds concerned. There is no necessity to issue any writ of mandamus to the State in that regard. As regards facilities for witnesses and victims are concerned, vulnerable witness depositions centers have already been set up in the court complexes. 3. Therefore, we do not see any reason to entertain this W.P.(PIL). It is accordingly, dismissed.
