JUDGMENT : (Nitin Jamdar, C.J.) Heard Mr. S. Vishnu, learned counsel for the Petitioner and Mr. P. Govind representing Mr. M.K. Padmanabhan Nair, learned Standing Counsel for the Navodaya Vidyalaya Samiti. 2. Being aggrieved by the rejection of O.A. No.459 of 2024, filed before the Central Administrative Tribunal challenging the transfer, the Petitioner - a teacher is before us with this petition. 3. The Petitioner has joined the transferred post. The Petitioner had contended that a teacher working with the Respondent Institution is willing to take the place of the Petitioner on exchange. The learned counsel for the Respondent Institution states that this was the position before filing the Original Application in the Tribunal, however, there is no clarity as to whether the said person is still willing. 4. No purpose will be served by keeping the petition pending as it is open to the Petitioner to apply to the Respondent Institution in case any teacher is willing to take the place of the Petitioner and thereafter it is for the Respondent Institution to take a decision based on the policy and the exigencies of administration. 5. The petition is disposed of accordingly.
