JUDGMENT : SANJAY PRASAD , J. This Criminal Appeal has been filed on behalf of the Appellant challenging the order dated 01.02.2025, passed in M.C.A. No. 56 of 2025, by the Additional Sessions Judge-1st-cum-I/C Special Judge SC/ST, Dhanbad, by which prayer for bail made on behalf of the Appellant, namely Pravin Singh @ Praveen Singh @ Praveen Kumar Singh has been rejected in connection with Katras P.S. Case No.01 of 2025, registered for the offence under Sections 191(2), 126(2), 115(2), 109(1), 352, 351(2), 324(4), 132, of Bharatiya Nyaya Sanhita, 2023 and for the offence under Section 3 (r), 3(s) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. 2. It is alleged that Informant and one another Constable, namely Sohan Tudu were on patroling duty in the night of 31.12.2024 and they received information about nuisance created by 8 to 10 youth at Railway Colony and inspite of introducing themselves as Police personnel to the said group of youth, they caught hold of the collar of the Informant using filthy word and called out to Constable 893 Sohan Tutu by his caste. On arrival of another patrol party, the said group started to flee away, but the appellant got caught and he disclosed about the other youths. 3. Learned counsel for the Appellant has submitted that the Informant has falsely implicated the appellant in this case and they were not creating any nuisance with the public in general and they are not abusing the public in general on the Eve of 31 st of December, 2024. The Police has wrongly used its power by arresting the Appellant. It has been submitted that the similarly situated co-accused, namely Rohit Kumar has been granted bail by this Court vide order dated 28.03.2025 passed in Criminal Appeal (S.J.) No. 169 of 2025. It is submitted that the Appellant is in custody since 01.01.2025, hence, he may be enlarged on bail. 4. Learned A.P.P. has opposed the prayer for bail and submitted that appellant and another person were making nuisance on the eve of New Year of 2024 and the appellant is the main person, who was apprehended at the spot by the Police. 5. It appears that the allegation against the appellant at best is that he was creating nuisance in general and had allegedly abused the Constable Sohan Tudu in the name of his caste. 7. Considering the custody of the appellant and the fact that co-accused Rohit Kumar @ Rohit has been granted bail by this Court, the appellant, namely, Pravin Singh @ Praveen Singh @ Praveen Kumar Singh is directed to be released on Bail, on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen thousand) with two sureties of the like amount each in connection with Katras P.S. Case No.01 of 2025, to the satisfaction of Additional Sessions Judge-Ist-cum-I/c Special Judge, SC/ST, Dhanbad. 8. Thus, this Criminal Appeal (S.J.) No.179 of 2025 is allowed.
