ORDER : SURAJ GOVINDARAJ, J. 1. The petitioner is before this Court seeking for the following relief’s ; a. Appoint a suitable person to act as a sole arbitrator to adjudicate the dispute of the parties herein as per arbitration clause in paragraph 4.2 of the agreement of sale dated 29.08.2020 contained in annexure-a read with rectification deed dated 01.12.2020 contained in annexure-b "8.2 in the event of any dispute arising under this agreement, either party may inform the other party of such dispute in writing. The seller and purchaser shall attempt to resolve the dispute amicably within 15 (fifteen) days of receipt of the notice regarding such dispute, failing which they shall submit to binding arbitration by a sole arbitrator jointly appointed by the seller and purchaser in accordance with the arbitration and conciliation act, 1996. The arbitration proceedings shall be conducted in the English language and the venue of arbitration shall be Bangalore city" and to refer the dispute to the said arbitrator. b. To pass such other directions or orders as this Hon’ble court may deem fit in the circumstances of the case and in the interest of justice. c. Award costs. 2. After arguing for sometime, learned counsel for respondents submits that she has no objection for appointment of an arbitrator, if all the contentions are left open to be decided by the learned arbitrator, so appointed. 3. In that view of the matter, I pass the following: ORDER i. CMP is allowed. ii. Shri Justice P. Krishna Bhat, former Judge of this Court is appointed as a sole arbitrator to arbitrate the dispute between the parties under the aegis of the Arbitration Centre attached to this Court. iii. Registry is directed to forward a copy of this order to the Director, Arbitration & Conciliation Centre for doing the needful. iv. Since the order is passed in the presence of both the counsels, the counsels are directed to appear before the Director, Arbitration & Conciliation Centre without requirement of any notice at 2.30 p.m. on 06.12.2025. v. All contentions are left open. vi. Original and/or certified copies if produced are directed to be returned to the respective parties who have produced it/them by following due procedure.
