ORDER : 1. Petitioners challenge the order dated 08-04-2025 in CAN No.4/2025 in MAT 531 of 2023 [Damodar Valley Corporation & Anr. vs. H P Ispat Private Limited & Ors.], MAT 523 of 2023 [Damodar Valley Corporation & Anr. vs. Expandable Enterprise Private Limited & Ors.], MAT 518 of 2023 [Damodar Valley Corporation & Anr vs. Alishan Steels Private Limited & Ors.] and MAT 522 of 2023 [Damodar Valley Corporation & Anr. vs. Sumangal Ispat Priave Limited & Ors.], passed by the High Court at Calcutta. 2. Learned counsel for the petitioners has invited our attention to the order dated 26th May, 2025 passed by the Co-ordinate Bench of this Court in S.L.P.(C) No.14035 of 2025, titled “Sumangal Ispat Private Limited & Anr. vs. Damodar Valley Corporation & Ors.”, which reads as follows: “1. Having heard learned senior counsel/counsel for the parties, and keeping in view the nature of prayer made in this Special Leave Petition, we dispose of the same with the following directions: i) The time to furnish the bank guarantee qua 50% amount is extended for a period of six months from today, subject to the condition that the petitioners shall not shift to any other distribution or generating company by terminating the contract with the respondents. ii) The petitioners shall provide post-dated cheques as security for the Bank Guarantee within one week. 2. Pending application(s), if any, shall stand closed.” 3. Learned counsel for the petitioners further submits that fresh post dated cheque(s) would be issued as security for the Bank Guarantee within a period of one week from today and learned counsel for the respondents submits that cheque(s) already issued by the petitioner shall be returned simultaneously. 4. On the joint prayer made by both the parties, the present Special Leave Petitions are disposed of in the aformentioned terms. 5. Pending application(s), if any, shall stand disposed of.
